Additional Information for Users in the Philippines

This Philippines Policy supplements and shall be read in conjunction with the SendVia Global Data Privacy Policy (“Global Policy”). The information in this Philippines Policy applies to the processing of personal information in the Philippines or of Philippine residents. The applicable laws shall include the Republic Act No. 10173 (also known as the “Data Privacy Act of 2012” or simply, “DPA”), its implementing Rules and Regulations, and issuances by the National Privacy Commission. This section supplements the Policy with additional information on how we process sensitive information and the rights of individuals regarding their personal information under the DPA.

 

Sensitive Information

We collect and process personal information as defined under the DPA, including sensitive personal information. Specific categories of data processed and purposes for processing can be found in the “Personal Information Collected” section of the Global Policy.

We may receive sensitive personal information directly from you, including health-related information, to advise on the best risk management package that meets your needs and to fulfill services under the selected risk management package. We collect and process your sensitive information for the purposes outlined in the Global Policy based on your consent. We will collect and process this sensitive information with care and confidentiality.

If you provide us with personal information or sensitive information about other individuals who reside in the Philippines in connection with the services we offer, you hereby represent that you have the authority to do so and have secured consent to permit us to use the information in accordance with this Philippines Policy and the Global Policy.

 

RIGHTS OF INDIVIDUALS UNDER THE DPA

You may have the right to exercise the following individual rights under the DPA, subject to certain exceptions:

Right of Access and Data Portability

You have the right to access the following personal information we process about you in a readable format:

  1. Contents of your personal data that were processed;
  1. Sources from which personal data were obtained;
  2. Names and addresses of recipients of the personal data;
  3. Manner by which such data were processed;
  4. Reasons for the disclosure of the personal data to recipients, if any;
  5. Information on automated processes where the data will, or is likely to, be made as the sole basis for any decision that significantly affects or will affect you; and
  6. Date when your personal data were last accessed and modified.

Right to Rectification

You have the right to have your personal data corrected or amended if it is incorrect.

Right to Object

You have the right to object to the processing of your personal information, including processing for direct marketing, automated processing or profiling.

Right to Erasure

You have the right to suspend, withdraw or order the blocking, removal or destruction of your personal data from our system.

Right to Damages

You may be entitled to seek compensation if you suffer damages due to false, incomplete, outdated, unlawfully obtained or unauthorized use of personal information, considering any violation of your and freedoms.

Right to File a Complaint

You have the right to lodge a complaint, when appropriate, before proper regulatory authorities.

Changes to Our Philippines Policy

We reserve the right to amend this Philippines Policy at our discretion and at any time. SendVia therefore asks all concerned residents of the Philippines to check it occasionally to ensure that you are aware of the most recent version.
